People often ask me whether they need to go to court immediately after they separate, and while there's no legal requirement to do so, it is important to note that some of the claims that are typically made in a family court case are time-limited, meaning that you cannot bring them whenever you want. For example, if you want to make a claim for equalization, also known as division of assets, you must make that claim within six years of separation or two years after divorce. Likewise, many other property claims may be subject to a two-year limitation, which means that you must bring those claims within two years of separation.
