What happens if I can't find my marriage license?
Hi, my name is Ash Mazinani. I'm a divorce and family lawyer in Toronto. I've had many clients come to me and tell me that they cannot find their marriage license, or that the marriage license, for whatever reason, wasn't registered on the day of the wedding by the officiant. And they ask me what the implications of this are. The law in Ontario provides for something called a good faith marriage, which essentially means that the court will operate under the assumption that you were married and treat you accordingly in determining your rights and obligations if you can establish that you had a good faith marriage, which means you intended to be married, you thought you were married, you acted like you were married, and you represented yourself to the community as a married couple. If you can prove this, the court will assume that you were married and treat you accordingly, even if you cannot provide the legal documentation to prove your marriage.
