What is the difference between married and common-law spouses when dividing property?
Married spouses are generally entitled to an equalization of Net Family Property under Ontario's
Family Law Act. Common-law spouses do not have an automatic right to property equalization.
In most cases, property belongs to the person who owns it unless a successful legal claim, such
as unjust enrichment or constructive trust, is established.
