4. How is parenting decision-making decided in Ontario?

Parenting decision-making is decided based on the best interests of the child. Ontario

and federal family law now use the term decision-making responsibility instead of

“custody.” Decision-making responsibility refers to major decisions about a child’s

education, health, religion, and important activities. Courts consider the child’s needs,

stability, relationship with each parent, each parent’s ability to care for the child, the

child’s views where appropriate, and any history of family violence.
