5. How is parenting time determined after separation or divorce?
Parenting time is the schedule for when a child is in each parent’s care. Courts decide
parenting time according to the child’s best interests, not according to an automatic
50/50 presumption. The court may consider the child’s routine, school schedule, age,
relationship with each parent, caregiving history, safety concerns, and each parent’s
willingness to support the child’s relationship with the other parent.
