10. How is a business valued in an Ontario divorce?
A business interest owned by either spouse may be included in net family property and
may require a professional business valuation. Business valuation can involve corporate
shares, partnership interests, retained earnings, goodwill, shareholder loans, and
income available to the owner-spouse. In family law litigation, parties may also require
income determination reports, forensic accounting, and disclosure of corporate records
